THAT REQUEST WAS TO GO FROM THE GENERAL AGRICULTURAL AG ONE LAND USE AND ZONING TO THE TO THE C3 GENERAL COMMERCIAL ZONING. THOSE REQUESTS WERE APPROVED. ADDITIONALLY, THERE WAS A REQUEST ON MEMORIAL CIRCLE TO CHANGE LAND USE AND ZONING FROM RESIDENTIAL IN R2 TO THE PUBLIC. INSTITUTIONAL LAND USE AND ZONING DESIGNATION THAT WAS APPROVED AS WELL. THOSE REQUESTS REQUESTS ON FRONT BEACH ROAD FOR PEACE PROPERTY CHANGED THE ZONING FROM PUBLIC INSTITUTIONAL TO C3 GENERAL COMMERCIAL. THAT WAS ALSO APPROVED. THEN THERE WAS A REQUEST FOR A PIECE OF PROPERTY THAT WAS FORMERLY IN LYNNHAVEN, BUT WAS DE-ANNEXED ESSENTIALLY WAS ON BRADENTON AVENUE. THE COUNTY COMMISSION VOTED TO DESIGNATE THAT PROPERTY AS GENERAL COMMERCIAL FUTURE LAND USE AND C3 A GENERAL COMMERCIAL ZONING, AND THAT WAS APPROVED AS WELL. THERE WAS ANOTHER LAND USE AND ZONING CHANGE REQUEST ALONG JONES AVENUE. THAT REQUEST WAS TO GO FROM OR IS TO GO FROM RESIDENTIAL TO NEIGHBORHOOD COMMERCIAL. AS NOTED, STAFF IS PROPOSING TEXT AMENDMENTS TO THE LAND DEVELOPMENT REGULATIONS CHAPTER 13. THESE REVISIONS INCLUDE SECTION 1302. THIS WOULD REVISE LANGUAGE TO BE CONSISTENT WITH STATUTORY REQUIREMENTS IN REGARD TO HOME OCCUPATIONS AND HOME OFFICES OF CONVENIENCE. SECTION 1303 CORRECTS AN INCONSISTENT INCONSISTENCY WITH THE DEFINITION OF A NIGHTCLUB, WITH THAT OF THE DEFINITION NOTED IN APPENDIX A. 1304. THIS INCLUDES EXISTING LANGUAGE FROM SECTION 3.5 OF THE COUNTY CODE OF ORDINANCES REGARDING ZONING REGULATIONS FOR ADULT USES. I WANT TO SPECIFY THAT THIS IS NOT NEW LANGUAGE. IT'S JUST LANGUAGE FROM OUR ORDINANCE THAT'S BEING INCORPORATED INTO THE LDR. SECTION 1305 PROVIDES LANGUAGE TO ALLOW A FENCE AS HIGH AS EIGHT EIGHT FEET WITHIN THE FRONT YARD SETBACK. CURRENTLY, [00:05:06] THE LDR RESTRICTS THAT TO FOUR FEET IF IT'S WITHIN THE FRONT YARD SETBACK. THEN 1306 REVISES THE REGULATIONS REGARDING CANNABIS DISPENSING FACILITIES TO BE COMPLIANT WITH STATUTORY PREEMPTION REQUIREMENTS. STAFF RECOMMENDS THE COMMISSION CONDUCT THE LEGISLATIVE PUBLIC HEARING. FIND THE PROPOSED AMENDMENTS CONSISTENT WITH THE COMPREHENSIVE PLAN AND THE LAND DEVELOPMENT REGULATIONS AND FORWARD RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS TO APPROVE THE PROPOSED AMENDMENTS.
