I INVESTIGATED THE PROPERTY AND FOUND IN VIOLATION OF BAY COUNTY CODE SECTION 172 IN THE FORM OF A UNFIT, UNSAFE UPPER DECK AND OVERGROWTH. PHOTOGRAPHS OF THE PROPERTY WERE INTRODUCED INTO EVIDENCE AS EXHIBIT A AND CONTAINED IN THE CASE FILE. AS YOU CAN SEE, THERE'S THREE DIFFERENT, I GUESS, TOWNHOMES. AND WE'RE LOOKING AT THE MIDDLE ONE THERE. YES, I COULD I COULDN'T SEE THE THE FRONT PORCH FOR THE OVERGROWTH, BUT I COULD SEE THE UPPER DECK WAS IN POOR SHAPE. ON JUNE THE 2ND, 2025, A BUILDING INSPECTION WAS CONDUCTED BY INSPECTOR SCOTT THORPE. WHEN INSPECTOR THORPE. I SUBMITTED MY CREDENTIALS FOR THE RECORD, I WAS ABLE TO INSPECT THIS AS A THREE TOWNHOMES. WE'RE TALKING ABOUT THE CENTER UNIT HERE. AS YOU CAN SEE IN THE PHOTOS, THE UPPER DECK AND LOWER SEVERELY ROTTED BALUSTERS ARE ROTTED ON THERE, ALONG WITH THE RAILINGS AND UPRIGHTS. THEY'RE MISSING SHINGLES DUE TO ROT JUST TO AGE AND WIND BORNE DAMAGE. A BUNCH OF MISSING AND LIFTED SHINGLES ON THERE. FASCIA SOFFIT AREA ROTTED ALONG THE FRONT. THIS IS THE BOTTOM DECK. YOU CAN SEE THE JOISTS ARE ROTTED OUT. DECK BOARDS ARE ROTTED AS WELL. OVER ON THE LEFT SIDE. IT WAS OCCUPIED AT THE TIME OF INSPECTION. LARGE NEST OF BEES UP THERE. THE RIM JOISTS THAT'S MOUNTED TO THE WALL THAT'S SEVERELY ROTTED ALONG THE SIDES IN THE BACK AS WELL. AND MISSING SOME LATERAL STRUCTURAL BEAMS THAT ARE UNDERNEATH THE FLOOR JOIST IS THERE ROTTED, AND THEY SEPARATED OFF THE JOIST HANGERS AS WELL ALONG THE FRONT. AND AS YOU CAN SEE, ALL THE BALLAST HAS BEEN NAILED AT ONE TIME, BUT THEY'RE ALL ROTTED IN. THE OUTER RIM JOIST ROTTED AS WELL. THERE'S THE FAR LEFT SIDE OF IT THERE. AS IT SITS. UNFIT, UNSAFE, UPPER AND LOWER DECK. WITH THIS IMPACT ON THE TWO ADJACENT, I HOPE NOT. IT'S A SINGLE UNIT. IT SHOULD [00:05:09] BE. THERE SHOULD BE A PARAPET OR LIKE A PARTY WALL BETWEEN THE UNITS. ON JUNE THE 4TH, 2025, A NOTICE OF VIOLATION WAS SENT, CERTIFIED AND REGULAR MAIL TO THE OWNER OF RECORD USING THE ADDRESS 4109 CHERRY STREET, PANAMA CITY, FLORIDA 3244. THE CERTIFIED NOTICE WAS RETURNED TO REGULAR MAIL. NOTICE DID NOT RETURN. ALSO SENT A COPY OF NOTICE OF VIOLATION AND BUILD INSPECTION REPORT. REGULAR MAIL TO THERESA DYER USING ADDRESS 8200 PALM COVE BOULEVARD, PANAMA CITY BEACH, FLORIDA 3248. THE REGULAR MAIL DID NOT RETURN ON JUNE THE 25TH, 2025, A RE INSPECTED THE PROPERTY. IT'S THE RESPONDENT'S RESPONSIBILITY TO CONTACT AND INFORM, INFORM CODE ENFORCEMENT OF ANY PROGRESS OR DELAYS IN BRINGING THE PROPERTY INTO COMPLIANCE.
